ANCESTOR TRAVELS – TERMS & CONDITIONS
The Terms & Conditions of our website are to be read carefully before using or obtaining any products, services, or content through our website. Access to and use of our website is subject to acceptance of the Terms & Conditions below, which include our Privacy Policy. By accessing or using our website, or by purchasing, booking, reserving, or obtaining any products or services from Ancestor Travels through any online or offline channel, you agree to be bound by these Terms.
Site
These Terms govern your use of all Content, Products, or Services available through our website. You agree to be bound by these Terms and to use the Site in strict compliance with all applicable laws, rulings, and regulations, and in a manner that does not negatively reflect on the goodwill or reputation of Ancestor Travels.
For the avoidance of doubt, these Terms are not limited to transactions made through our website. They also apply to any purchase, booking, reservation, or service obtained through telephone calls, WhatsApp, email, in-person communication, through an Ancestor Travels employee or representative, or through any other authorized online or offline communication or booking channel.
Additional Terms
Additional Terms may apply when you purchase Products or Services, or when you participate in special promotions or offers. For example, airlines have contracts of carriage, hotels have cancellation policies, and promotions are subject to specific rules. These Additional Terms are found in the area of the Site where you will purchase a Product or Service, or where you will register for a special promotion, and may also be communicated separately through a quotation, invoice, booking confirmation, email, WhatsApp, or other communication channel.
You agree to abide by the terms and conditions imposed by any Provider, including payment of the entire amount when due, and to comply with all rules and restrictions regarding the availability of Products or Services.
Responsible Party
You are fully responsible for maintaining the secrecy of your User Name and Password. This is necessary to protect the confidentiality of any information that may be stored in the My Account tab. In addition, you will be financially accountable for all use of our Site by yourself and anyone using your password and login information, except to the extent otherwise provided by applicable law.
Copy, Distribution or Sale
You may download, display, or print reasonable portions of the content for your personal, non-commercial use, provided that you do not modify the content and retain all applicable copyright and proprietary notices.
Except as expressly permitted by Ancestor Travels or applicable law, you cannot copy, reproduce, upload, post, republish, display, transmit, or distribute any part of the content from Ancestor Travels without our prior written permission.
You cannot sell, offer for sale, license, or transfer any portion of the Site or its content in any form to any third party without our prior written permission. You cannot reverse engineer any part of the Site.
Other Limitations
Unless otherwise provided within these Terms, or unless specific applicable law requires us to allow you to do so, you may not do any of the following without the prior written consent of Ancestor Travels:
- Using this Site other than to make legitimate inquiries, reservations, or bookings;
- Using a spider, robot, crawler, or any other automatic device to monitor or extract content from the Site;
- Using this Site to make fraudulent, false, duplicate, or speculative reservations or reservations in anticipation of demand;
- Placing false or misleading information;
- Implying in any sense that Ancestor Travels is endorsing any product or service without our prior written authorization;
- Posting or transmitting any threatening, unlawful, obscene, defamatory, libellous, indecent, pornographic, inflammatory, or profane material, or any other material which is considered a criminal offence, may give rise to civil liability, violates any law, or is otherwise unlawful;
- Using any device or software which might interfere with or attempt to interfere with the normal operation of the Site;
- Transmitting or uploading to our Site, or using, any kind of software, device, or routine containing Trojan horses, viruses, worms, time bombs, malware, or other routines which may interfere with, damage, or attempt to intercept or damage the normal operation of our Site.
Termination
Ancestor Travels has the sole discretion, where legally permissible, and may at any time and without advance notice or liability restrict or terminate your access to any or all components of our Site, even if access continues to be allowed to others.
Upon such suspension or termination, you must immediately discontinue using the Site.
Such suspension or termination shall not affect any payment obligations, liabilities, or rights that have already accrued.
Ownership Rights and Trademarks
This website is the exclusive property of Ancestor Travels. Ancestor Travels retains all rights, title, and interest, including trademark, copyright, patent, trade secrets, and all other intellectual property rights, in and to the Site.
The Site is protected by trademark, copyright, patent, unfair competition, trade secret, and other applicable laws, as well as international treaties. Any unauthorized use, modification, reproduction, distribution, or exploitation of this Site or its content may lead to violation of such laws.
We may charge a fee or commission for the services we provide when you purchase, book, or reserve travel services or accommodations through our Site or through any other booking channel accepted by Ancestor Travels. Any such service fee shall be non-refundable, unless otherwise expressly stated in writing by Ancestor Travels or otherwise required by applicable law.
In addition, you will be responsible for all applicable charges, fees, duties, taxes, and assessments arising out of your use of the Products and Services available from the Site or obtained through Ancestor Travels.
Reservations, Bookings and Purchases
You agree to follow the terms and conditions of purchase imposed by any supplier with whom you choose to deal.
A supplier who is an Air Carrier is required to make available to the public the terms of its contract of carriage, and where applicable, Ancestor Travels makes available the fare rules for Air Carrier tickets before purchase.
Bookings and purchases made through telephone, WhatsApp, email, in person, through an Ancestor Travels employee or representative, or through any other authorized channel shall also be subject to these Terms.
By confirming a booking, authorizing Ancestor Travels to proceed with a booking, making any payment toward a booking, accepting a quotation or invoice, receiving a ticket or voucher, or using a service arranged by Ancestor Travels, you acknowledge and agree to these Terms and any applicable Additional Terms or supplier terms.
Where a booking is made verbally, the customer's verbal confirmation or authorization to proceed with the booking shall constitute acceptance of the applicable booking terms, subject to applicable law.
Payment and Confidentiality
We ensure that every transaction that you conduct through Ancestor Travels is handled through appropriate payment and transaction procedures.
Where payment is made through a third-party payment gateway, you may be redirected to the payment gateway website for entering your card or payment details.
We do not store complete credit or other card details on our own servers, subject to the policies, systems, and technical practices of the applicable payment gateway or payment service provider.
ANCESTOR TRAVELS – CREDIT & PAYMENT POLICY
At Ancestor Travels, we value the trust of our clients and strive to maintain a transparent relationship. To ensure smooth transactions and uninterrupted travel services, the following Credit & Payment Policy shall apply:
1. General Payment Terms
1.1. All dues must be cleared at least 24 hours prior to the utilization of any ticket, voucher, accommodation, transportation, tour, or other travel service, unless otherwise agreed in writing by Ancestor Travels.
1.2. Payments must be made in full as per the agreed amount and within the stipulated timeline.
2. Credit Facility
2.1. Credit is not a standard practice and may only be extended on special request and at the sole discretion of Ancestor Travels.
2.2. Where credit is provided, the client shall ensure that all dues are cleared within the given timeline, unless otherwise agreed in writing.
2.3. Any extension of credit beyond the standard policy shall be treated as a gesture of goodwill and does not establish a precedent or create any continuing right or entitlement for future bookings.
3. Client Responsibility
3.1. The client is responsible for ensuring timely clearance of all dues.
3.2. Ancestor Travels shall not be held liable for any loss, cancellation, forfeiture, disruption, or other consequence arising from non-clearance of payments, subject to applicable law.
3.3. Any financial loss reasonably incurred by Ancestor Travels due to delayed payments may be recovered from the client, where applicable and legally permissible.
4. Consequences of Non-Payment
4.1. Failure to clear dues within the agreed timeframe may constitute a breach of the booking/payment agreement.
4.2. In case of delay in payment beyond the agreed due date, interest at the rate of 24% per annum (equivalent to 2% per month) may be charged on the outstanding amount for the period commencing from the due date until the date of actual payment, subject to applicable law.
4.3. The interest shall be calculated only on the overdue/outstanding principal amount and shall be payable in addition to the principal amount due.
4.4. In case of pending payments, Ancestor Travels reserves the right, subject to applicable law, to:
- Withhold, cancel, or deny further bookings.
- Suspend or withdraw any extended credit facilities.
- Charge applicable interest on overdue amounts as specified above.
- Take legal recourse for recovery of outstanding dues, if required.
4.5. Any financial loss, bank charges, cancellation charges, supplier penalties, or other reasonable costs incurred by Ancestor Travels as a direct result of delayed or non-payment may also be recovered from the client, where applicable and legally permissible.
5. Policy Enforcement
5.1. This policy is binding on all clients availing services of Ancestor Travels, whether such services are booked or purchased online or offline.
5.2. By proceeding with a booking, authorizing Ancestor Travels to proceed with a booking, making any payment toward a booking, accepting a quotation or invoice, receiving a ticket or voucher, or using any service arranged by Ancestor Travels, the client is deemed to have read, understood, and agreed to this Credit & Payment Policy.
5.3. This Credit & Payment Policy applies irrespective of whether the booking is made through the Ancestor Travels website, telephone, WhatsApp, email, in person, through an Ancestor Travels employee or representative, or through any other authorized communication or booking channel.
5.4. Any specific payment or credit terms agreed in writing for an individual booking shall apply to that booking and shall prevail to the extent of any inconsistency with the general payment terms stated in this Policy.
CANCELLATION, REFUND AND NON-REFUNDABLE CHARGES
6. Non-Refundable Amounts
6.1. Any amount, fee, service charge, booking charge, cancellation charge, supplier charge, convenience fee, or other amount expressly identified or communicated by Ancestor Travels as “Non-Refundable” shall remain non-refundable, unless Ancestor Travels expressly provides otherwise in writing.
6.2. A customer shall not be entitled to assume or claim a refund merely because a refund has been requested. A refund shall only be processed where it is permitted under the applicable supplier terms, the applicable booking conditions, or where Ancestor Travels expressly agrees to provide such refund.
6.3. Ancestor Travels may, before or after a booking, provide the customer with a refund quotation, cancellation quotation, cancellation charges, revised refund calculation, or written refund approval, where applicable.
6.4. Where Ancestor Travels provides a written refund quotation or refund approval specifying that a refund is available, the refund shall be processed in accordance with the terms, deductions, conditions, and validity specified in that quotation or approval.
6.5. The provision of a refund quotation or cancellation quotation by Ancestor Travels shall not, by itself, create an entitlement to a refund unless the quotation or written communication expressly confirms that the refund is approved or payable.
6.6. Any refund shall be subject to applicable supplier rules, cancellation charges, service fees, payment gateway charges, bank charges, taxes, administrative charges, and other applicable deductions, as communicated by Ancestor Travels.
6.7. Where a supplier does not provide a refund, Ancestor Travels shall not be required to provide a refund of the supplier component, except where otherwise required by applicable law or expressly approved by Ancestor Travels in writing.
6.8. Any service fee or other amount expressly communicated as non-refundable shall remain non-refundable unless Ancestor Travels expressly provides a written refund quotation, refund approval, or other written confirmation allowing such amount to be refunded, subject to applicable law.
7. Cancellation
7.1. Cancellation of a booking shall be subject to the cancellation terms applicable to the relevant Product or Service and the terms of the relevant supplier.
7.2. Cancellation charges may apply even where the customer requests cancellation after confirmation but before utilization of the service.
7.3. Any cancellation or refund amount communicated by Ancestor Travels shall be based on the applicable supplier rules, booking conditions, and charges applicable at the relevant time.
7.4. Ancestor Travels may communicate the applicable cancellation charges and/or estimated refund amount to the customer before or after cancellation, where applicable.
7.5. The final refund amount, if any, shall be determined after application of all applicable supplier charges, cancellation charges, service fees, taxes, payment charges, bank charges, and other applicable deductions.
8. Customer Acknowledgement
By confirming a booking, making payment, authorizing Ancestor Travels to proceed with a booking, accepting a quotation or invoice, receiving a ticket or voucher, or using a service arranged by Ancestor Travels, the customer acknowledges that:
- they have had an opportunity to review these Terms & Conditions;
- they agree to the applicable Credit & Payment Policy;
- they agree to applicable supplier terms and conditions;
- they understand that certain services, fees, and charges may be non-refundable;
- they understand that cancellation and refund amounts may be subject to supplier rules and applicable charges; and
- any refund shall be provided only in accordance with the applicable terms or an express written refund approval or refund quotation issued by Ancestor Travels.
By using the Ancestor Travels website or by purchasing, booking, reserving, or availing any product or service from Ancestor Travels through any online or offline channel, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions, the Credit & Payment Policy, and any applicable Additional or supplier-specific Terms.
